These Terms of Use ("Terms") govern your use of the Aside mobile application and related service (the "Service") provided by PaliAi, LLC ("we", "us", "our"). Qorq is our consumer product studio and Aside is one of its products.

By using Aside, you agree to these Terms. If you do not agree, do not use the Service. Contact us at [email protected].

1. Eligibility

You must be at least 13 years old, or the minimum age required in your country, and legally able to agree to these Terms.

2. Your Access

Aside can create a private installation session without requiring an account. You may optionally use Sign in with Apple for recovery and multi-device access. You are responsible for keeping your device and account credentials secure and for activity under your access. Contact us if you believe your access has been compromised.

An anonymous library may be unrecoverable if you lose the installation credential before linking it to an account.

3. Your Content

"Your Content" includes links, text, notes, photos, screenshots, conversations, and other material you submit.

• Ownership. You retain your rights in Your Content.
• Limited license. You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, reproduce, and display Your Content only as needed to provide, secure, support, and improve the Service for you.
• Your responsibility. You represent that you have the rights needed to submit Your Content and that doing so does not violate law or another person's rights.

4. AI-Generated Information

Aside uses automated systems to organize saved content and answer questions. Generated titles, summaries, tags, suggestions, and answers may be incomplete, inaccurate, or biased. Check important information against the saved original.

Aside is not a substitute for professional medical, legal, financial, safety, or emergency advice. You are responsible for decisions you make using the Service.

5. Free and Premium Service

Aside may offer a limited free tier and an Aside Premium auto-renewing subscription. The price, billing period, trial terms, and included features shown in the App at purchase are the terms of your offer.

• Payment is charged to your Apple Account when you confirm a purchase.
• A subscription renews automatically unless cancelled at least 24 hours before the current period ends.
• Your Apple Account is charged for renewal within 24 hours before the current period ends.
• You can manage or cancel in iOS Settings → Apple Account → Subscriptions. Deleting the App does not cancel a subscription.
• Restore Purchases is available in the App.
• Apple processes billing and refund requests under its policies: https://reportaproblem.apple.com

We may change future pricing or features with notice as required by law and App Store rules.

6. Acceptable Use

You may not:

• Use the Service unlawfully or violate intellectual-property, privacy, publicity, or other rights.
• Upload malware or content that exploits or sexually abuses children.
• Harass others or submit content you are not permitted to process.
• Probe security, bypass access controls or usage limits, disrupt the Service, or access another person's data.
• Use bots, scraping, or automated traffic that burdens or abuses the Service.
• Reverse engineer the Service except where applicable law expressly permits it.
• Use the Service or its outputs to build or train a competing model or service without our written permission.

We may restrict or terminate access that violates these Terms or creates security, legal, or operational risk.

7. Our Intellectual Property

The Service, including its software, design, branding, and content other than Your Content, is owned by PaliAi, LLC or its licensors and protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service under these Terms.

8. Availability and Changes

We may add, remove, change, suspend, or discontinue features. We aim to protect saved originals and provide clear states when processing fails, but we do not promise uninterrupted or error-free availability. You may stop using Aside and delete your data at any time.

9. Third-Party Services

Aside relies on services such as Apple, Clerk, RevenueCat, AI model providers, and cloud infrastructure. Their services may be governed by separate terms and policies.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT GENERATED INFORMATION WILL BE ACCURATE.

Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PALIAI, LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL, ARISING FROM THE SERVICE. OUR TOTAL LIABILITY FOR A CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR ASIDE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.

Nothing in these Terms limits liability or consumer rights that cannot legally be limited.

12. Indemnification

To the extent permitted by law, you agree to indemnify and hold PaliAi, LLC harmless from claims, losses, and reasonable expenses arising from Your Content, your misuse of the Service, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Courts located in Delaware have exclusive jurisdiction, except that you may bring an eligible claim in small-claims court or exercise non-waivable rights available where you live.

14. Apple-Specific Terms

These Terms are between you and PaliAi, LLC, not Apple. Apple is not responsible for the Service and has no obligation to provide maintenance or support. If the iOS App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price to the extent required by its rules; Apple has no other warranty obligation to the maximum extent permitted by law. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions against you.

15. Changes

We may update these Terms. Material changes will be communicated in the App or on this page. Continued use after revised Terms take effect means you accept them.
